NICK’S WAY ANNUAL FISHING TOURNAMENT RELEASE

The Nick’s Way Fishing for Mental Wellness (the “Tournament”) is brought to you by Nick’s Way, a 501 (c)(3) Virginia non-profit organization. In consideration of the participation in the Tournament being held on the Shenandoah River and at Watermelon Park Campground and the Shenandoah Cools Springs Campus located in Virginia(the “Property”), I, acting for myself and any minor children under my care, custody or responsibility (each a “Minor” and one or more the “Minors”), hereby freely and voluntarily agree to the following representations, waivers, and agreements:
I understand that(a) fishing and accessing rivers and streams and other bodies of water for fishing purposes and generally engaging in physical activity on the Property (collectively, “Activities”) involves risk, including risk of personal injury and death; and (b) while engaging in Activities, I will be exposed to risks that independently or in any combination of the Activities or Activities of others may cause injury, including potentially severe or fatal injuries, to myself or others. I agree that I alone am responsible formy proper preparation and safety, and the proper preparation and safety of any Minor, while engaging in any of the Activities.. Neither I nor any Minor has any physical or medical condition that would endanger me, any Minor, or others, while I am engaging or any Minor is engaging in Activities. I am, and each Minor, is physically capable of participation in the Activities and can engage in the Activities without any assistance from Nick’s Way.
Being fully aware of the risks, conditions and hazards associated with the participation in Activities, I, for myself and any Minor agree to assume the risk of physical injury to myself and any Minor or loss of my or any Minor’s personal property and hereby agree to indemnify, defend and hold harmless Nick’s Way, the owners of any Property used during the Tournament, and the Tournament, and any and all of their respective officers, directors, shareholders, partners, employees, personnel, contractors, or agents thereof from liability for any and all injury, loss, illness, harm or damage resulting from my or any Minor’s participation in the Activities other than that which directly results from the gross negligence or willful misconduct of Nick’s Way.
I also agree, for myself and any Minors, that the above waivers, releases, and indemnifications are not mere recitals, but are binding, and are intended to be as broad and inclusive as permitted by the laws of the Commonwealth of Virginia. If any term or provision of this Agreement is found invalid or unenforceable, the remaining terms and provisions of this Agreement shall remain binding and enforceable.
I, acting for myself and any Minor, have executed this Release on the date shown below.
FOR ADULTS: I acknowledge that I am 18 years of age or older, and that I have read and understand the contents of this document on behalf of me and any Minors.
